How do I file a complaint?
For any complaints or grievance by a student or against the student: The aggrieved or concerned party must immediately notify the Office of the Director of Student Services or the Head of Student Services in the case of branches and satellite campuses. The Office of the Director of Student Services must attempt to resolve all grievances and concerns through consultation and dialogue with the concerned parties. In all cases, the ODSS will recommend that the parties go to the Office of Counseling and Psychological Services for intervention and assessment of their psychological condition. For cases settled amicably, the OCPS shall provide recommendations or assessments to the ODSS, and cases that fail to reach an amicable settlement shall be referred to the Student Disciplinary Board for appropriate action. The OCPS shall also forward the case record and assessment to the SDB. For cases initiated by students against a faculty member or a non-teaching personnel: The ODSS shall refer the complaint to the OVPAA, OVPA, or OVPBC for appropriate action. For record or referral purposes, the OVPAA, OVPA, or OVPBC must provide the ODSS with copies of its resolution(s), recommendation(s), finding(s), and/or action(s). If the parties do not reach a settlement, the OVPAA, OVPA, or OVPBC shall refer disciplinary or administrative cases to the President to establish an investigation committee following CSC rules or to forward the case or complaint to the Office of the University Legal Counsel for appropriate action.

Should the complaint be in writing?
Yes. All complaints, both disciplinary and non-disciplinary, are required to be presented in writing, signed by the complainant(s), and filed before the Office of the Director of Student Services (ODSS).

What should be the content of the complaint letter?
The letter of complaint must contain the following information: The complete name and address (if known) of the complainant and the person(s) complained of, as well as his/her/their position(s) and office(s); A detailed narration of the relevant facts, demonstrating the actions orallegedly involved; if any; and If applicable, submit certified true copies of any documentary evidence and affidavits from witnesses. Certification or statement from non-forum hopping.

Do we entertain anonymous complaints?
Under the Civil Service Rules, no anonymous complaint shall be entertained unless there is obvious truth or merit to the allegations therein or supported by documentary or direct evidence, in which case the person complained of may be required to comment. (Section 11, Rule 3 of the 2017 RACCS)

What is the Student Disciplinary Board (SDB)?
The Student Disciplinary Board (SDB) is a multi-sectoral adjudicatory body mandated to hear and decide cases filed against a student except for cases involving sexual harassment, which should be referred to the Committee on Decorum and Investigation.

What is the composition of the Student Disciplinary Board (SDB)?
The Student Disciplinary Board (SDB) shall be composed of two representatives from the student sector, recommended by the SKM President; one representative from the faculty, recommended by the Faculty Federation; one representative from the administrative employees, recommended by the Employees Union, and one representative from the administration, designated by the University President. The majority of its membership shall constitute a quorum necessary for the conduct of disciplinary proceedings. The presiding officer shall be elected from among its members. In the absence of the duly elected SKM President, a student representative to the SDB and CODI shall be recommended by the Student Regent. In the absence of the duly elected SKM President and Student Regent, a representative to the SDB and CODI shall be recommended by the Director of Student Services and approved by the Vice President for Student Affairs and Services.

What is the process before the SDB?
Upon receipt of referral from the ODSS, the SDB shall require the complainant to submit a sworn affidavit with proof of service to the respondent within a period of five (5) calendar days from receipt of the order. In the same directive, respondent will be given a period of three (3) calendar days to file counter-affidavit. Failure on the part of the respondent to comply shall be deemed a waiver thereof. Whenever necessary, reply to the answer and rejoinder may be allowed. The proceedings shall be summary in nature but with the view of protecting the right of the parties to due process. All cases referred to the SDB shall be resolved within ten (10) calendar days from submission to resolution. In the resolution of cases, the SDB shall be guided by the disciplinary sanctions provided under Title 9 hereof or recommend the same in accordance with Section 4 of Title 9, taking into consideration the justifying and mitigating circumstances attendant in a case. The Student Disciplinary Board is mandated to submit to the President through the Vice President for Student Affairs and Services a written report of all the resolutions, findings, actions, recommendations and proceedings undertaken in the exercise of its adjudicatory functions. The decision of the SDB involving complaints where the penalty is lower than suspension of one (1) month shall be final. For complaints where the penalty is more than one (1) month suspension, the SDB shall make the proper recommendation to the Vice President for Student Affairs and Services who shall render a decision based on such recommendation. Appeal – The decision of the Vice President for Student Affairs and Services may be appealed within the period of ten (10) calendar daysfrom receipt of the assailed decision in the Office of the President. The decision of the Office of the President is final and executory.

What is the procedure for sexual harassment complaints?
Sexual harassment cases shall be heard and decided pursuant to the provisions of CSC Resolution No. 01-0940, dated May 21, 2001, and the same shall be handled by the Committee on Decorum and Investigation (CODI), duly formed and constituted by the University President.
